What is a criminal record? Which service provider assists you to be issued it fast and with prestige? By definition, a criminal record provides information on convictions, judgements, outcomes by Courts, judgement enforcement, ban on taking up positions, establishing or managing enterprises or cooperatives in case such enterprises or collectives are announced bankrupt by Court.

Vietname criminal record is among required documents in applying for work permit for foreign workers regardless of the fact that foreign workers just enter Vietnam or required documents produced by Vietnamese people in applying for entering foreign countries, getting married, working overseas and so on.

Law on Criminal Record

State agencies which are authorized to issue criminal records:

1, National Center for Criminal Record shall issue criminal records in following cases:

  • Vietnamese citizens whose permanent or temporary residence addresses are not identified
  • Expats who have resided in Vietnam

2, Justice Departments shall issue criminal records in following cases:

  • Vietnamese citizens permanently or temporarily residing in Vietnam
  • Vietnamese citizens living in foreign countries
  • Expats residing in Vietnam

Classification of criminal records:

Criminal Record Card No. 1

  • To be issued at the request of Vietnamese citizens, expats who are residing in Vietnam and when required by State agencies or organizations.
  • Applicant’s information provided in this kind of criminal record: birthplace, birthdate, full name, sex, nationality, place of residence, ID or passport number
  • Convictions:
    • For those who have never violated Laws or whose convictions have been spent, “no convictions” will be shown in the card.

    • For those who once violated Laws or are not eligible for spent convictions, “conviction(s) found” will be given in the card with specific contents of the convictions provided.

    • Additionally, if an individual wants to be provided additional information related to taking up positions, establishing or managing enterprises or cooperatives, such information shall be added to the card.

  • Expats who apply for a work permit are only required to produce Criminal Record Card No. 1

Criminal Record Card No. 2

  • To be issued to agencies carrying out prosecution procedures or at the request of individuals who want to know their criminal background.
  • Applicant’s information provided in this kind of criminal record: birthplace, birthdate, full name, sex, nationality, place of residence, ID or passport number, full name of close relatives including father, mother, husband or wife if appropriate
  • Convictions:
    • For those who have never had any convictions, “no convictions” will be shown in the card.

    • For those who have had convictions, “conviction(s) found” is to be given. Detailed information on spent convictions, unspent convictions and Court’s decisions is required.

    • Information about ban on taking up positions, establishing or managing enterprises or cooperatives

    • For those who are not subject to ban, “not be banned on taking up positions, establishing or managing enterprises or cooperatives” is to be given in the card.

    • For those who are subject to ban, details related to ban on taking up positions, establishing or managing enterprises or cooperatives under the decision on announcement of bankruptcy.

Documents to apply for a criminal record:

  • Application for the criminal record made according to a given form.
  • 1 copies of ID card or passport
  • 1 copies of household registration book
  • 1 copies of permanent resident certification or temporary resident certification or temporary resident card (if applicant is an expat, if any)

In case the applicant authorizes another person to submit his/her application (applicable only to Criminal record card no. 1), following documents shall be added:

  • Original of the authorization letter conducted by a private notarization office (if the authorized person is father, mother, husband/wife, or child of the applicant, the authorization letter is not required).
  • ID card (or passport) of the authorized person
  • The applicant is not allowed to authorize another person to submit his/her application for criminal record card no. 2. He/she shall submit the application by himself/herself.
